"Bİ ŞOFÖR" is the smart application owned by Bi Şoför Taşımacılık
Hizmetleri Turizm Sanayi ve Dış Ticaret Ltd. Şti.
"CUSTOMER" The person registered with the application and buy order
using the App.
"APPLICATION" Bİ ŞOFÖR's application or web site which can be used
on mobile and other devices with internet connection where the
services and which all intellectual and industrial property rights
are owned by Bİ ŞOFÖR.
"DRIVER" In the mobile application of Bİ ŞOFÖR, Drivers who work
after their applications are approved.
"CONTRACT" is the subject of these terms of use, the terms of use of
the services to be provided through the user CUSTOMERS and the Bİ
ŞOFÖR APPLICATION, and the determination of the rights and
obligations of the parties related to this.
Application and Membership
The customer downloads the application, fills in the required
sections for registration, confirms the verification code sent to
the GSM number, enter password and can start using it in accordance
with the content of these Terms of Use.
The Customer, accepts that all information provided while
registering to the App is complete, accurate and up-to-date at all
times and in every respect. Customer may update its information at
all times through the App.
The Customer, After completing all the sections required for
registration on the Application, declares and accepts that the
personal data shared with Bİ ŞOFÖR will be processed within the
scope of the Clarification Text included in the application.
The use of App is free of charge. Services offered within the
application are paid.
Use of the App
Customer downloads the Application, registers for the Application
and after opening the Application, selects one of the services Now,
Daily, Gesture or Intercity. Within the service chosen, marks
location or the address wants for pickup on the Application, clicks
on the "Let the Driver Come" button, the driver who is closest to
customers location or desired address is directed by the system.
When the Driver accepts the call, arrives at the location marked by
the Customer in the application during the estimated arrival time.
Customer may cancel the request until the Driver accepts the call.
For cancellations made after the Driver accepts the call,
cancellation fees are charged to the Customer's credit or debit card
registered in the system.
Cancellation fees; After the Customer confirms the service chosen,
can cancel it free of charge for once within 5 minutes. In case of
more than one cancellation, Bİ ŞOFÖR has the right to freeze the
account automatically. For cancellations longer than 5 minutes, the
entire "Initial Fee" of the requested service is charged to the
Customer's credit or debit card registered in the system. The
Customer accepts, declares and undertakes to collect these
cancellation fees from the credit card or debit card registered in
the system.
Customer agrees and undertakes to meet at the agreed location, at
the agreed time with the Driver, in case of a Now, Daily, Gesture or
Intercity driver request.
Customer can make the payment via the application by choosing one of
the debit card, credit card or cash options. Customer is deemed to
have performed its payment obligations owed to Bİ ŞOFÖR upon making
payments to Bİ ŞOFÖR.
Customer cannot request a new service without paying the service
fee.
In the Customer's service requests, in cases where the Driver does
not come to the address entered through the Application, no
cancellation fee is charged from the Customer.
If the Customer is not present at the promised time and place agreed
with the Driver, and the Driver cannot be reached to Customer, the
Driver will wait for a total of 20 minutes and leave the meeting
point by informing Bİ ŞOFÖR in writing on the grounds that the
Customer has not fulfilled his commitment. In this case, the
customer accepts, declares and undertakes to collect the service fee
and the entire unit price without the campaign, which has chosen
from the credit card or debit card registered in the system.
If the Customer is present at the agreed time and place agreed with
the Driver, the Driver informs the Customer through the Application
when arrives at the meeting place and waits for a maximum of 10
minutes free of charge. Waiting after 10 minutes is calculated
according to the "Pricing" policy in the App and added to the total
amount.
At the end of the service received by the Customer, the Driver ends
the journey through the application. The calculated amount appears
on the Customer's screen in the application and the confirmation
button appears. The Customer makes the payment by clicking the
'Confirmation' button. With the realization of the payment, the
Customer's payment obligation ends.
Customer may use 3D Secure option for payment transactions to ensure
information security.
Customer will be required to enter her/his credit or debit card
information onto the App Payment System once, after which she/he
will be able to use the Online Payment System without being required
to enter additional informaiton.
If the credit card or debit card being used on the Online Payment
System does not have sufficient limit or the credit card payment
cannot be processed for any other reason, the Customer can use
another previously saved credit card/bank card or can make a payment
again by defining a new credit or debit card.
If the Customer does not approve the payment despite receiving
service, he/she accepts, declares and undertakes to collect the
entire service fee from the credit card or debit card registered in
the system.
Customer is liable to pay the minimum "Initial Fee" in cash to the
Driver when the service starts. When the trip is over, the customer
is obliged to pay the remaining amount in cash to the driver, after
deducting the initial fee from the total service fee.
In case of cancellations regarding service requests made by the
Customer by marking a Cash payment, the cancellation fee is
collected from the Customer's credit or debit card registered in the
system. The Customer accepts, declares and undertakes to collect
these cancellation fees from the credit card or debit card
registered in the system.
Customer's credit card or debit card information is not known by Bİ
ŞOFÖR, online payment infrastructure is provided by organizations
that have legal permissions in this regard.
If the Customer's electronic devices (phone, computer, tablet, etc.)
on which the Customer has downloaded and used the Application are
stolen or lost, the card information cannot reach third parties.
However, Customer is required to notify Bİ ŞOFÖR and terminate its
use of the card. Third parties may otherwise be able to continue
making Bİ ŞOFÖR order payments through the App. Bİ ŞOFÖR cannot be
held responsible in such cases.
Customer can report positive and negative opinions about the Driver
that he/she receives service from. It can give points through the
system and report the driver that it is complaining about to Bİ
ŞOFÖR via the Application or by calling Customer Services. Bİ ŞOFÖR
conducts a detailed examination of the complaint, gives the
necessary warnings to the driver in cases where the driver is at
fault, and may terminate the business relationship with the driver,
depending on what the fault is or if it is repeated. The Bİ ŞOFÖR
application aims to provide the best service in line with the needs
of the Customer and has meticulously selected its drivers for this
purpose. But other than these, the Driver cannot be held responsible
under any circumstances in connection with his behavior.
Customer agrees to use the App lawfully and properly and that he/she
will be legally held liable for any unlawful action using the App.
Bİ ŞOFÖR cannot be held liable directly or indirectly for any
unlawful transaction made and/or action taken within or through the
App by the Customer.
Customer agrees that Bİ ŞOFÖR cannot be held responsible, directly
or indirectly, for any transactions and/or actions performed by the
Driver and/or third parties in violation of these Terms or law over
the App or via the App.
Customer agrees not to take any action that could be abusive of the
services offered by Bİ ŞOFÖR paid/free of charge.
Customer agrees that she/he is fully responsible for the security
and storage of her/his system access tools (username, password,
etc.) used in order to benefit from the services offered by Bİ ŞOFÖR
through the App.
Customer agrees will not to use any visual and auditory image in the
App that will constitute to Driver's and/or any other third parties'
real or personal rights and assets.
Customer declares and accepts that she/he has voluntarily made
her/his vehicle available to a third party through the Application
and that, as the owner or user of the vehicle, she/he is aware of
the legal responsibility of this situation and takes this
responsibility herself/himself.
In case the vehicle, for which service is requested, lacks
automobile insurance and compulsory traffic insurance, Bİ ŞOFÖR is
entitled to refuse to deliver the service.
Customer accepts that she/he is personally responsible for all
damages or compensations in case of accident, damage, fire, etc.
that may occur during the journey, service, inside or outside the
car. Customer declares and undertakes that Bİ ŞOFÖR shall not be
held responsibleand that the Customer will not claim any
material/non-pecuniary damages from Bİ ŞOFÖR with regard to the same
and the Customer waives those rights, declares and undertakes that
she/he will use her own car insurance or personal means to repair
the damage.
Customer can benefit from promotions or campaigns. In order to
benefit from the relevant promotion/campaign, the Customer must
comply with the terms of the promotion/campaign and must not engage
in fraudulent behavior (including making misleading statements or
creating false Customer profiles to take advantage of the
promotion/campaign).
Customer may cancel her/his membership at any time by pressing the
"Cancel Membership" or calling Bİ ŞOFÖR customer services at 0850
3083888. Customer cannot open another record with the GSM number
she/he defined for her/his canceled membership, but she/he can
reopen her/his canceled membership with the same information.
Customer may not use, share, distribute, exhibit, reproduce or make
derivative works of all property rights subject to the property of
Bİ ŞOFÖR without the permission of Bİ ŞOFÖR.
Bİ ŞOFÖR reserves the right to suspend or terminate the Customer's
membership to the App in case the Customer breaches these Terms.
Bİ ŞIFÖR makes every effort to reflect the truth, such as the
estimated arrival time of the driver guided through the application,
and the distance between her/his and the Customer. However, cannot
be held responsible for the fact that this information does not
reflect one hundred percent truth.
In the event Customer fails to utilize services due to technical
malfunctions caused by Customer, Bİ ŞOFÖR shall not be held liable
for its failure to perform its obligations and no claim can be made
to Bİ ŞOFÖR in such respect, under any title.
Driver/Personnel providing services within the scope of the
application are personally subject to the provisions of the
applicable legislation due to their behavior and words that would
constitute a crime. In such cases, Bİ ŞOFÖR has no responsibility.
Bİ ŞOFÖR may withdraw, suspend and/or terminate the access of the
Customer to the App in case the Customer acts in violation of the
relevant campaign/promotion conditions and/or engages in a
fraudulent manner.
These terms shall be valid and will continue to be in effect until
the Customer terminates her/his membership.
Bİ ŞOFÖR is not responsible for any direct or indirect damages and
expenses that may arise as a result of any errors, interruptions,
delays, viruses, line and/or system failures that may occur during
the use of the Mobile Application.
Bİ ŞOFÖR reserves the right to change, update, suspend or stop the
services, information, images and other elements offered through the
mobile application without prior notice. It is the Customer's
responsibility to follow the current version of the application.
Bİ ŞOFÖR, the design of the App, the software, html code and all
kinds of trademarks, designs, logos, trade dress, slogans and all
other content created by Bİ ŞOFÖR regarding them are the property of
Bİ ŞOFÖR.
The implemnetation and interpretation of these Terms shall be
governed by and the legal relationships arimsing hereunder will be
construed in accordance with the laws of the Republic of Turkey and
any dispute arising hereunder or in connection with these Terms
shall be settled by Istanbul (Central) Courts and Execution Offices.
This Agreement has entered into force with Customer clicking the "I
accept the terms, declares and undertakes." button, mutual agreement
of the Parties following the on-line approval of Customer.
Privacy Policy and Protection of Personal Data
Bİ ŞOFÖR attaches importance to the protection and confidentiality
of its customers' information. Bİ ŞOFÖR take utmost care to process
and protect the personal data of customers, in accordance with the
Personal Data Protection Law No. 6698 ("the PDPL"),
Detailed information about the measures taken by Bİ ŞOFÖR's to
protect personal data for Customers;
Bİ ŞOFÖR process your personal data based on the legal grounds
specified in Articles 5 the Law on the Protection of Personal Data.
Based on the legal reason that it is necessary to process your
personal data for the establishment or performance of a contract;
For Bİ ŞOFÖR services signing up process to mobile application and
transactions regarding account creation, to verify your identity and
ensure account activation, receiving drivers requests, directing the
appropriate driver according to the demands, executing the
communication between drivers and customers,
Based on the legal ground that data processing is necessary to
fulfill our legal obligations; for the purposes of fulfilling our
legal obligations and conducting our activities in accordance with
the legislation, in cases where authorized institutions or
organizations make a request from Bİ ŞOFÖR or where we are expected
to notify these institutions,
Based on the legal ground that data processing is mandatory for the
establishment, exercise, or protection of a right; in case of a
possible dispute, for the purposes of protecting and exercising our
rights, executing legal processes, and following up and concluding
requests/complaints,
Based on the legal ground that data processing is necessary for our
legitimate interests, provided that it does not harm the fundamental
rights and freedoms of the data subject; within the scope of mobile
application use, prevention of fraud and forgery, detection and
analysis of financial and security risks, detection, prevention and
development of system errors and problems encountered in application
use, supervision and data analysis in order to improve the services
offered, ensuring the security and functionality of the services and
application processes offered, conducting customer satisfaction and
communication processes.
For commercial electronic message submissions, explicit consent is
also required. In addition, commercial electronic messages will not
be sent unless you have given explicit consent.
We also process your location data in order to enable the driver and
customer to confirm their location and to meet with the driver at
the designated location, if you allow your location data to be
processed when logging into the mobile application or in the
application settings,
The information collected through the mobile application and the
purposes of using this information are as follows;
Name-surname, gender, profile photo,
Customer ID,
Phone number, e-mail, address, favorite address,
Payment instruments, payment amount, payment method, payment and
invoice details,
Order history, order information, number of orders,
Application usage information, services visited within the
Application, preferences, likes, interests and usage habits,
advertising ID (identifiers), billing information, comments, points
and evaluation information,
To provide access to the domains within the Application,
Examining, evaluating and finalizing the customer's
requests/complaints regarding the services received,
Working towards customer satisfaction,
Bİ ŞOFÖR conducting our activities in accordance with the
legislation and to store the data that is required to be retained
within the scope of our legal obligations.
Bİ ŞOFÖR review of services, carrying out reporting studies on the
products and services of the Application,
To detect and prevent fraud and abuse of our campaigns, discounts,
and the services.
To inform Customers about updates, fixes and innovations in the
application,
Conducting legal processes,
