Terms of Use and Privacy Policy

  1. Definitions

    In the context of these Terms of Use and Privacy Policy:

    1. "BiŞoför" - refers to the intelligent mobile application owned by BiŞoför Taşımacılık Hizmetleri Turizm Sanayi ve Dış Ticaret Ltd. Şti.
    2. "CLIENT" - refers to an individual who registers with the BiŞoför application and purchases services through the application.
    3. "APPLICATION" - refers to the mobile or web-based software owned by BiŞoför, through which the services are provided via mobile and other internet-connected devices. All intellectual and industrial property rights to the Application belong to BiŞoför.
    4. "DRIVER" - refers to a driver listed on the BiŞoför application who is authorized to provide services upon approval of their application by BiŞoför.
    5. "AGREEMENT" - refers to these Terms of Use, which govern the conditions for utilizing services provided via the Application, as well as the rights and obligations of the parties.
  2. Registration and Completion of Application
    1. The Client initiates the registration process by entering their mobile phone number after downloading the Application. Upon verification of the confirmation code, access to the Application is granted. The name and surname are requested only during the order placement stage.
    2. Upon completing these steps, the User is deemed to have accepted these Terms of Use and may begin using the Application.
    3. The Client undertakes that all information provided during registration is complete, accurate, up-to-date, and belongs to them personally, and agrees to update such information as necessary. Personal data can be updated at any time through the Application.
    4. By completing all mandatory fields, the Client is deemed to have accepted the processing of their personal data shared with BiŞoför in accordance with the Clarification Text provided within the Application.
    5. Use of the Application is free of charge. However, services provided through the Application are subject to fees.
  3. Use of the Application
    1. The Client downloads the Application, completes the registration process, and selects one of the following services: Sober Driver, Private Driver, or Travel Driver.
    2. Within the scope of the selected service, the Client marks their current location or the address from which the driver should be dispatched and clicks the “BiŞoför Gelsin” (“Call BiŞoför”) button. The system directs the nearest available driver to the specified address.
    3. Once the driver accepts the request, they arrive at the designated location within the estimated arrival time.
    4. The Client may cancel their request free of charge before the driver accepts it. However, if the driver has already accepted the request, cancellation fees will be charged to the Client’s registered credit or debit card.
    5. After confirming the service, the Client is entitled to one free cancellation within 5 minutes. In the case of multiple cancellations, BiŞoför reserves the right to temporarily suspend the relevant account.
    6. For cancellations after 5 minutes, a portion of the service fee is charged; if the driver has already arrived at the Client’s location, the full “starting fee” is charged. The Client acknowledges and agrees that these amounts may be charged to their registered card.
    7. The Client agrees to meet the driver at the mutually agreed time and location.
    8. Payment may be made via the Application using a credit/debit card or in cash. Once payment is completed, the Client's payment obligation is deemed fulfilled.
    9. The Client cannot request a new service unless the previous payment has been completed.
    10. If the driver fails to reach the designated address, the Client will not be charged a cancellation fee.
    11. If the Client is not present at the agreed meeting point and time and is unreachable, the driver may leave the location after waiting for 20 minutes and notifying BiŞoför in writing. In this case, the full unit price of the service (without discounts or promotions) will be charged to the Client’s registered card.
    12. If the Client is present at the meeting point at the agreed time, the driver notifies the Client via the Application upon arrival and waits for 10 minutes free of charge. Any additional waiting time will be charged in accordance with the “Pricing” policy.
    13. At the end of the service, the driver ends the trip through the Application, and the payment screen is displayed. If the payment method is card, the amount is charged automatically; if cash is selected, the Client pays the driver directly.
    14. The Client may securely complete the payment using the 3D Secure feature.
    15. After entering card details once, the Client may use the same card for future transactions without re-entering information.
    16. In the event of insufficient balance, the Client is obligated to complete the payment using another registered card or by adding a new one.
    17. If the Client receives the service but does not confirm the payment, the service fee will be charged through the system automatically.
    18. For cash payments, the Client pays the “starting fee” upfront at the beginning of the trip and the remaining amount at the end.
    19. If the Client fails to make the cash payment, the full service fee will be charged to the registered card.
    20. BiŞoför does not have access to card information; all transactions are processed through legally authorized payment infrastructure providers.
    21. In case the Client’s device is lost or stolen, card data cannot be accessed by third parties. However, unless BiŞoför is notified, the Application may remain active, and BiŞoför cannot be held liable for any resulting transactions.
    22. The Client may provide feedback regarding the service received, rate the driver, or submit a complaint. BiŞoför will evaluate the complaint and take necessary action but cannot be held directly liable for driver behavior.
    23. The Client agrees to use the Application solely for lawful and appropriate purposes.
    24. In the event of any illegal activities by the Driver or third parties, BiŞoför shall not be held responsible.
    25. The Client agrees to refrain from any actions that may constitute misuse or abuse of the system.
    26. The Client is responsible for maintaining the confidentiality of their access credentials (e.g., username, email, etc.).
    27. The Client agrees not to use any content that may harm the property, rights, or freedoms of third parties.
    28. In cases where the Client allows a third party to operate their vehicle, the Client assumes full legal responsibility.
    29. If the vehicle does not have comprehensive or mandatory traffic insurance, BiŞoför reserves the right to deny service.
    30. The Client is solely responsible for all accidents, damages, and losses that may occur during the service; BiŞoför cannot be held liable for any compensation claims.
    31. The Client may only benefit from campaigns and promotions in accordance with their rules; in cases of fraudulent use, BiŞoför reserves the right to revoke such benefits.
    32. The Client may cancel their membership through the “Delete Account” option or by contacting customer support. Re-registration with the same information is permitted.
    33. The Client may not use BiŞoför’s brand name, logo, or design elements without prior authorization.
    34. BiŞoför reserves the right to suspend or terminate the accounts of users who violate these Terms.
    35. Estimated arrival times for drivers are provided as accurately as possible, but absolute accuracy is not guaranteed.
    36. BiŞoför shall not be held responsible for service failures due to technical issues arising from the Client’s side.
    37. Drivers are personally responsible for any actions that constitute criminal offenses; BiŞoför cannot be held liable for such actions.
    38. In the event of violations of campaign rules, BiŞoför reserves the right to cancel the campaign or restrict access to the Application.
    39. These Terms enter into force upon the Client’s registration with the Application and remain valid for the duration of the membership.
    40. BiŞoför shall not be liable for any damages arising from technical problems, interruptions, or system vulnerabilities.
    41. BiŞoför reserves the right to update, modify, or suspend the content of the Application without prior notice.
    42. All design, content, and software rights of the Application belong to BiŞoför. Unauthorized use is strictly prohibited.
    43. Turkish law shall apply to the interpretation and enforcement of these Terms. In the event of a dispute, the courts and enforcement offices of Istanbul shall have jurisdiction.
    44. This Agreement enters into force upon the Client’s electronic confirmation by clicking the “CONTINUE” button.
  4. Privacy Policy and Protection of Personal Data
    1. BiŞoför values the privacy and security of Client data. All personal data is processed and protected in accordance with Law No. 6698 on the Protection of Personal Data (KVKK).
    2. In accordance with Article 5 of KVKK, BiŞoför processes Clients’ personal data based on the following legal grounds:
      1. Within the scope of contract formation and execution:
        • Performing registration and membership processes;
        • Identity verification and account activation;
        • Receiving and directing driver requests;
        • Facilitating communication between the Client and the Driver.
      2. Within the scope of legal obligations:
        • Submitting mandatory reports to authorized institutions;
        • Fulfilling legal obligations;
        • Conducting BiŞoför's operations in accordance with applicable legislation.
      3. For the establishment, exercise, and protection of rights:
        • Protection of rights in case of disputes;
        • Managing legal proceedings;
        • Responding to and resolving Client requests and complaints.
      4. Within the scope of legitimate interest:
        • Preventing fraud and forgery
        • Analyzing financial and security risks
        • Detecting and resolving technical issues in the Application
        • Enhancing service quality, monitoring, and functionality
        • Improving customer satisfaction and managing communication processes
    3. Commercial electronic communications are sent only with the Client’s explicit consent. No communication is sent without such consent.
    4. Location data is processed only when the Application is open and location sharing is enabled in device settings. This data is used to accurately determine the pick-up location.
    5. BiŞoför takes all necessary technical and administrative measures to ensure the confidentiality of personal data collected through the mobile application.
