In accordance with the employment contract concluded between myself and my employer “BiŞoför”, BiŞoför Taşımacılık Hizmetleri Turizm Sanayi ve Dış Ticaret Ltd. Şti., and pursuant to the relevant provisions of the Labor Law No. 4857, I hereby undertake the following:

• That I shall perform my duties with due diligence, in accordance with procedures, and with the required seriousness throughout the duration of my employment, in line with my professional experience and knowledge;
• That all information provided by me to BiŞoför during the job application process is complete, accurate, up-to-date, and personally belongs to me;
• That, after being employed, I shall not use any information acquired by BiŞoför or learned during the performance of my duties in any place without the written permission of BiŞoför;
• That I shall keep all information providing BiŞoför a competitive advantage confidential and shall not disclose such information to third parties under any circumstances;
• That I shall keep confidential all information belonging to BiŞoför that I have obtained through my duties, and that I shall not engage in any activities that may result in unfair competition;
• That I shall not engage in any conduct that may harm the intellectual and industrial property rights related to any brand, design, logo, commercial presentation format, slogan, and all other content belonging to the BiŞoför mobile application and its owner BiŞoför Taşımacılık Hizmetleri Turizm Sanayi ve Dış Ticaret Ltd. Şti., and that I shall not use such assets without authorization;
• That I shall not disclose any confidential data developed by BiŞoför and learned by me during my employment, beyond the scope of my duties or to third parties via any medium, without the explicit permission of BiŞoför;
• That in the event my employment is terminated for any reason, I shall neither use nor retain any information acquired during the performance of my duties; and in the event of a breach of this obligation, I shall be personally liable for all damages incurred by BiŞoför;
• That I shall not use any data belonging to BiŞoför, directly or indirectly, in any manner that may result in material or moral damage;
• That I shall comply with the confidentiality of all information, services, products, and software provided by the BiŞoför application; that I shall not provide any information in this context to any organization and shall keep all current and updated data confidential;
• That I shall keep confidential all customer-related data, such as vehicle details, phone numbers, and addresses, acquired during my duties; and that I shall not share such information with any individual or entity; and that I shall not record or share my communications with customers with third parties;
• That I shall not establish any personal or commercial relationships with customers whom I have contacted in connection with my duties without the express permission of BiŞoför; and that in case of a breach of this provision, I shall pay all compensation requested by BiŞoför in full and in a lump sum;
• That I shall not make any written or verbal statements that may disturb customers during or after the execution of my duties; and that I shall not engage in any unlawful or immoral conduct;
• That I shall not use for any unauthorized purpose any materials or equipment (such as mobile phone, tablet, computer, information, documents, or any technological devices) delivered to me for the execution of my duties; and that I shall return all such equipment in full upon the termination of the employment contract;
• That in the event of encountering a situation contrary to BiŞoför's information security and confidentiality, I shall immediately report the matter to the Human Resources department or company management;
• That I have received all training related to occupational health and safety and that I shall fully comply with these regulations;
• That I shall act in accordance with the job description related to my duties and that I have received all necessary training in this regard;
• That I shall not deliberately cause any damage to the interior or exterior of the vehicle during the execution of my duties; and that I accept full responsibility, to the extent of my fault, for any accidents or material/moral damages that may occur during the performance of my duties; and that neither I nor anyone acting on my behalf shall hold BiŞoför liable in any way;
• That I am fully aware of the responsibilities and risks associated with my duties;
• That I shall use all tools, materials, and equipment belonging to customers I serve in accordance with the applicable usage guidelines;
• That I shall not exceed the speed limits set by law, and that I shall be personally liable for any material and moral damages resulting from speeding or traffic violations;
• That I shall not consume any alcohol, tobacco, or prohibited substances before or during the performance of my duties if their effects persist at the time of starting work;
• That I shall maintain wage confidentiality, shall not disclose my salary to any other personnel, and that I accept any legal consequences arising from breach of this obligation;
• That I shall not operate a vehicle without a valid driver’s license; and that in the event of any administrative penalty or confiscation of my license, I shall immediately inform BiŞoför’s management and refrain from performing duties in such a situation;
• That I shall comply with the instructions and working principles provided by BiŞoför prior to the commencement of duty;
• That I acknowledge, declare, and undertake that all instructions, warnings, and notices specified in this undertaking have been previously communicated to me by my employer BiŞoför, and that in the event I breach any of these undertakings, my employer shall have the right to immediately terminate my employment contract without notice and for just cause.

By clicking the “LOG IN” or “REGISTER” buttons, this Agreement shall be deemed electronically accepted and shall enter into force.

The personal data of BiŞoför employees is processed in accordance with the Personal Data Protection Law No. 6698 (“KVKK”).

• Method and Legal Basis of Personal Data Collection

  Your personal data is collected through job application forms, résumés (CVs) you have submitted, information provided during interviews, information given after the commencement of employment, and data obtained from public institutions and organizations.

  Your personal data is processed:

  • Based on your explicit consent, in cases where such consent is given;
  • In the absence of explicit consent, based on other legal grounds stated in the KVKK, including:
    • When explicitly prescribed by law,
    • When directly related to the establishment or performance of a contract,
    • When necessary for the establishment, exercise, or protection of a right,
    • When necessary for BiŞoför to fulfill its legal obligations,
    • When required for the legitimate interests of BiŞoför, provided that this does not violate your fundamental rights and freedoms,
    • Or when necessary for BiŞoför to fulfill any legal obligation.
• Transfer of Personal Data

  Your processed personal data and special categories of personal data may be transferred under the data processing conditions set forth in Articles 8 and 9 of the KVKK to the following parties:

  • Company management,
  • Certified Public Accountants and Sworn-in Financial Advisors responsible for managing the company’s financial affairs,
  • Service provider companies from which we receive support and consultancy, Independent audit firms within the scope of legal obligations and statutory limitations,
  • Company legal counsels,
  • Authorized public institutions and organizations,
  • Judicial authorities or law enforcement agencies where required by legal obligations.
• Categories of Processed Personal Data
  • Identity Information: Name, surname, date of birth, gender, marital status, passport/ID card information, etc.
  • Contact Information: Phone number, full address, e-mail address, emergency contact person’s phone number, etc.
  • Special Categories of Personal Data: Health report, criminal record, proof of residence, copy of driver’s license, military service status, etc.
  • Educational Information: Graduation details, certificates, diplomas, etc.
  • Employment/Insurance Information: Personnel number, employment start/end dates, title, department, number of working days, SGK (Social Security Institution) records, etc.
  • Bank Information: IBAN and account details, etc.
  • Visual Information: Passport-sized photograph, etc.
• Purposes of Processing Personal Data
  • Execution of the recruitment and contract process for the driver,
  • Planning human resources processes and creating employee files,
  • Allocation of work equipment such as vehicles, phones, and SIM cards,
  • Management of occupational health and safety processes,
  • Ensuring communication between BiŞoför and the driver,
  • Management of communication between the driver and the customer,
  • Creation of the driver’s account and budget information,
  • Display of driver information on customer screens,
  • Monitoring of legal processes,
  • Tracking of drivers' working hours and minutes,
  • Contacting relevant persons in case of emergencies.
• Use of Location Data

  Our mobile application collects location data for the purpose of providing transportation and logistics services.

  • These data are processed for real-time navigation, driver location tracking, customer matching, and improving service efficiency.
  • Even when the application is running in the background, location data may still be collected as long as the driver’s session is active.
  • These data are shared only with authorized persons (e.g., customers) and internal operational teams. They are not shared or sold to third-party advertisers.
  • Users are informed before location access is granted and consent is obtained. This consent can always be revoked from device settings; however, doing so may affect the functionality of the application.
  • Location data is stored solely for the purposes listed above and in accordance with applicable laws and company policies.
• Declaration of Explicit Consent

  Pursuant to the Personal Data Protection Law No. 6698, I have read and understood this Clarification Text, which has been prepared to inform me about who will process my personal data, for what purposes, to whom and for what reasons the data may be shared, the method of data collection, and the legal basis thereof. For the purpose of implementing all provisions set forth in the above Undertaking, Personal Data Protection Policy, and this Clarification Text, I hereby give my explicit consent for the registration, processing, storage, updating, transfer when necessary, and other processing activities concerning my personal and special categories of personal data by BiŞoför. I accept, declare, and undertake to comply with all the provisions set forth in the above-mentioned Undertaking, Personal Data Protection Policy, and this Clarification Text.
